Interpretive presumptions and democratic principles: towards a framework for analysis
Lecture
Hanna Wilberg, member of the Auckland University Faculty of Law since 2004, will be discussing recent assertive uses of interpretive presumptions in UK and New Zealand case law. Starting from the assumption that special justification consistent with democratic principles is required where uses of presumptions cut across legislative intention, she will argue for an understanding of legislative intention that is itself consistent with democratic principles.
